VOLUNTEER WAIVER

I, the undersigned participant, intending to be legally bound, do hereby certify that I am qualified, in good health, and in proper physical condition to participate in any and all activities designed and/or supervised by an employee and/or representative of Adventure Fit INC (“Activities”). I further certify that I understand the physical nature of any and all Activities, including but not limited to Activities in or on land, natural terrain, roads and parking lots with or without vehicular traffic, sidewalks, and structures, and completed on foot, or bicycle. I also certify that I have voluntarily applied to participate in any and all Activities.

By digitally signing below, I ACKNOWLEDGE, agree, and represent that I FULLY UNDERSTAND that: (a) THE ACTIVITIES INVOLVE RISKS AND DANGERS of serious bodily injury, including permanent disability, paralysis, and death; (b) these risks and dangers may be caused by my own actions or inactions, the actions or inactions of others involved in and/or responsible for the Activities, or the condition in which the Activities take place; (c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation in the Activities.

COVID WAIVER

Old Man Winter Rally (“the Event”) has put in place preventative measures to reduce the spread of COVID-19; however, the Event cannot guarantee that you will not become infected with COVID-19. Further, attending the Event could increase your risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I maybe exposed to or infected by COVID-19 by attending the Event and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Event may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Event employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at the Event or participation in Event programming (“Claims”). On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless the Event, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Event, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Event program
